TERMS AND CONDITIONS

Welcome to Stitch’d Up Apparel, operated by Ivoca Pty Ltd, ABN 55 669 082 731 (“we”, “us” and “our”). These terms apply when you use our website or purchase from our online store.

Please read these terms before placing an order.

1. Orders and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Delivery charges and the total payable are shown before you complete checkout.

Payment must be received in full before your order is processed. Your order confirmation acknowledges that we have received your order. Acceptance occurs when we confirm dispatch.

If an item is unavailable, a listing contains an error or we cannot fulfil your order, we will contact you to arrange an alternative or refund any amount paid for the affected items.

2. Product information

We aim to display our products, colours, designs and descriptions accurately. Colours may vary between screens and physical products.

Product images may include digital mockups. Print placement and scale may vary slightly between garment styles and sizes. These variations do not limit your rights if a product is faulty or materially different from its description.

Please check the product description and size guide before ordering.

3. Made-to-order and personalised products

Some products are printed or made to order. Orders are normally dispatched within 7–10 days from the date the order is placed, including processing and production. Delivery time is additional. We will contact you if an outstanding artwork approval affects the expected dispatch date.

For personalised orders, please check all names, spelling, sizes, colours and artwork carefully. If we provide a proof, your approval authorises us to produce the order using that proof.

Changes or cancellations may be possible before production starts. Once production has started, we do not accept change-of-mind cancellations or returns for personalised products. This does not affect your rights under Australian Consumer Law.

4. Customer-supplied artwork

By supplying artwork, logos, images or wording, you confirm that you have permission to use and reproduce that material.

You give us permission to use the supplied material to fulfil your order. You retain ownership of your original artwork.

We may decline requests involving unlawful material or material we reasonably believe infringes another person’s rights.

5. Shipping and delivery

Our Shipping Policy forms part of these terms. Shipping charges are displayed at checkout. Production time is separate from delivery time unless stated otherwise.

Delivery timeframes are estimates unless we expressly agree to a guaranteed date. If you need an order for a particular event, contact us before purchasing.

Please provide a complete and accurate delivery address. Additional delivery costs may apply if an order must be resent because you supplied an incorrect address or did not collect it.

If your parcel is delayed, damaged or missing, contact us so we can investigate and help resolve the issue. Nothing in these terms removes our responsibilities under Australian Consumer Law.

6. Returns, refunds and exchanges

Our Returns and Refunds Policy explains how to request a return, refund or exchange and forms part of these terms.

We do not offer change-of-mind returns for personalised or custom-made products. For other products, change-of-mind returns are subject to our Returns and Refunds Policy.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights apply to sale items and personalised products as well as full-priced products.

If you receive an incorrect or faulty item, please contact hello.stitchdupapparel@gmail.com with your order number and details of the issue. Photos may help us assess your request. We will cover reasonable return postage costs where required by Australian Consumer Law.

7. Product care

Follow the care instructions supplied with your garment or shown on the product page.

Damage caused by misuse, unsuitable washing or drying, or failure to follow reasonable care instructions may not qualify for a remedy. This does not affect your rights where a product is faulty.

8. Promotions and discounts

Promotions are subject to any conditions advertised with the offer, including expiry dates and product exclusions.

Discount codes must be entered at checkout and cannot be combined unless stated otherwise. We do not apply discounts retrospectively unless the offer says otherwise.

9. Our designs and website content

Website content and original Stitch’d Up Apparel designs are owned by us or used with permission. Purchasing a product does not transfer intellectual property rights in its design.

You must not copy or reproduce our original designs, branding or website content for commercial purposes without permission.

10. Privacy

We handle personal information in accordance with our Privacy Policy. Please read that policy for details about how information is collected, used and disclosed when you use our store.

11. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we are not responsible for loss caused by your misuse of a product or your breach of these terms.

12. Changes to these terms

We may update these terms from time to time. The terms published when you place your order apply to that purchase.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, subject to any mandatory consumer laws that apply to you.
